These Terms of Service ("Terms") govern your access to and use of mlempets.com (the "Site") and any products purchased through it, operated by Mlem LLC, a Pennsylvania limited liability company ("Mlem," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you represent that you meet this requirement.

2. Products

Mlem sells pet food and pet food topper products, including under the Wag-U brand. Product descriptions, images, and pricing are subject to change without notice. We make reasonable efforts to display product information accurately, but we do not warrant that descriptions or other content are error-free.

Product Use and Disclaimer: Wag-U and other Mlem products are intended as a food topper for dogs. They are not recommended for dogs with pancreatitis or other fat metabolism disorders. Always consult your veterinarian regarding your pet's specific dietary needs, especially if your pet has an existing health condition. Mlem is not liable for adverse reactions resulting from misuse, failure to follow feeding guidelines, or failure to consult a veterinarian where appropriate.

3. Orders and Payment

• All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or errors in pricing or product information.
• Payment is processed securely through our third-party payment processor at the time of order.
• You are responsible for providing accurate billing and shipping information.

4. Subscriptions (Subscribe & Save)

If you enroll in a recurring subscription plan:

• Your selected products will be automatically charged to your payment method on file and shipped at the cadence you choose (e.g., every 30, 45, or 60 days).
• You may cancel, pause, or modify your subscription at any time prior to the next processing date through your account or by contacting josh@mlempets.com.
• If a payment fails, we may retry the charge or suspend your subscription until payment is updated.
• Subscription pricing and available cadences are subject to change with reasonable advance notice.

5. Shipping and Delivery

Estimated shipping times are provided for convenience and are not guaranteed. Mlem is not responsible for delays caused by carriers, weather, or other events outside our control. Risk of loss and title to products pass to you upon our delivery to the carrier.

6. Returns and Refunds

Because Wag-U is a consumable pet food product, we generally do not accept returns of opened products for hygiene and safety reasons. If your order arrives damaged, defective, or incorrect, please contact us at josh@mlempets.com within 14 days of delivery for a replacement or refund. Unopened, unused products may be eligible for return within 30 days of delivery at our discretion.

7. Promotions, Discount Codes, and Creator Links

From time to time, we may offer discount codes or promotional links through affiliates, creators, or partners. These are subject to the terms stated at the time of the offer and may be modified or discontinued at any time. Misuse of discount codes (including unauthorized redistribution) may result in order cancellation.

8. Intellectual Property

All content on the Site, including text, graphics, logos, product names (including Mlem and Wag-U), and images, is the property of Mlem LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

9. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to the Site or its systems
• Interfere with the proper functioning of the Site
• Submit false or misleading information when placing an order

10. Limitation of Liability

To the fullest extent permitted by law, Mlem LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased through it. Our total liability for any claim arising out of these Terms or your purchase will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or personal injury caused by a defective product where required by law.

11. Indemnification

You agree to indemnify and hold harmless Mlem LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

12. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, except as expressly stated in these Terms or required by law.

13. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles, except where applicable consumer protection laws in your state of residence provide otherwise. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Effective Date." Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
